Antony Waste Handling Cell Limited (AWHCL) has received an order from the Hon'ble Supreme Court of India dated May 05, 2026, in the matter of "Bhiwandi Nizampur City Municipal Corporation" versus "Antony Waste Handling Cell Limited". The Supreme Court has dismissed the Special Leave Petition filed by the Bhiwandi Nizampur City Municipal Corporation (BNCMC), which challenged the Bombay High Court's order. The litigation pertains to a Solid Waste Management contract awarded to AWHCL by BNCMC in 2005. Following BNCMC's breaches and illegal termination, AWHCL initiated arbitration proceedings in March 2013, claiming loss of profit. An arbitrator ruled in favor of AWHCL for claims exceeding ₹15 crore with interest. Subsequently, BNCMC agreed to a settlement of ₹15 crore, which was approved by the Corporation's Standing Committee and consent terms were executed. The Bombay High Court recorded this compromise on July 3, 2020, and by a final order on March 5, 2021, upheld the validity of the settlement. BNCMC challenged the High Court's order by filing a Special Leave Petition before the Supreme Court on August 24, 2021. The Supreme Court, in its order on May 05, 2026, dismissed this petition and has instructed BNCMC to disburse the due amount within three months from the judgment date. Failure to do so will result in the amount carrying interest at 9% per annum from the date the compromise was initially arrived at.
